Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Zenith: Cosmic Guide mobile application (iOS) and website (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Please review our Privacy Policy and our Turkish KVKK Aydınlatma Metni, which explain how we process personal data.

1. Eligibility and Anonymous Accounts

• ✦You must be at least 18 years old to access or use the Service.
• ✦By using the Service, you represent and warrant that you have the full legal capacity to enter into a binding agreement.
• ✦The Service uses an anonymous account created automatically on your device. You are not required to provide an email, password, or third-party sign-in credentials.
• ✦You are solely responsible for maintaining physical security over your device and for all activities carried out under your anonymous account.

2. The Service — Description and Scope

Zenith: Cosmic Guide provides a digital spiritual wellness and reflection platform. All readings, charts, and conversational outputs delivered through the Service are generated entirely by Artificial Intelligence (AI) systems:

• ✦Tarot & Palm Readings: Personalized tarot interpretations and real-time palm readings generated entirely by AI models.
• ✦AI Guide Consultations: Chat conversations and spiritual reflections conducted with interactive AI personas.
• ✦Dream Interpretation: Symbolic analysis of user-submitted dream logs generated using AI language models.
• ✦Soulmate Drawings: Personalized artistic sketches generated by AI based on user-selected preferences.
• ✦Cosmic Transits & Audio: Daily planetary transits, guided breathing rhythms, and meditative soundscapes.

Features may vary depending on your subscription tier. We reserve the right to refine, modify, or update features to maintain service performance.

3. In-App Purchases, Subscriptions & Coins

3.1 Subscriptions

• ✦Zenith: Cosmic Guide offers auto-renewable subscription plans (weekly, monthly, and annual) billed through Apple’s in-app purchase system (StoreKit).
• ✦Pricing and billing periods are presented clearly prior to confirmation and on the App Store product listing.
• ✦Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the renewal date.
• ✦Any free trial converts to a paid recurring subscription unless cancelled prior to expiration.
• ✦How to cancel: Go to iOS Settings → [Your Apple Account] → Subscriptions → Zenith: Cosmic Guide → Cancel Subscription. Cancelling within the app interface alone does not cancel your Apple StoreKit billing.

3.2 Coins (Virtual In-App Currency)

• ✦Coins are virtual in-app tokens used exclusively to initiate AI guide readings, palm readings, and specialized AI analyses.
• ✦Coins are purchased via Apple In-App Purchase and possess no real monetary value outside the Service. They cannot be transferred, resold, or redeemed for cash.
• ✦If a technical error prevents an AI reading from generating, the spent coins will be refunded directly to your in-app coin balance.

3.3 Refunds

All payments are processed by Apple Inc. Refund requests must be submitted directly to Apple at reportaproblem.apple.com according to Apple’s applicable consumer refund policies.

4. Entertainment Disclaimer — Spiritual Content

If you are experiencing medical distress, psychological crisis, or an emergency, please contact qualified emergency medical professionals or licensed services immediately.

5. Artificial Intelligence — Disclosures and Limitations

• ✦All guides (including Sofia, Maya, Elena, Rafael, Aylin, Lucia, Noor, Daniel, Priya, Camila, Vera, and Zenith) are fictional AI personas. Their portraits are AI-generated, and their biographies are fictional constructs. There are no human readers, clairvoyants, or psychics.
• ✦Readings and conversations are generated algorithmically by machine learning models in approximately one minute. They do not reflect the opinions or professional judgment of human advisors.
• ✦AI responses may occasionally be metaphorical, speculative, or inaccurate. You should always exercise independent judgment and common sense.
• ✦Using AI features requires explicit in-app consent upon first use. You may withdraw consent at any time via Settings → “AI data sharing”, which disables AI features while leaving other features active.

6. AI Guides and Failed Generation Policy

• ✦Guides available in the app represent distinct algorithmic styles, focus areas, and reflective tones created for user engagement.
• ✦Because AI generation depends on cloud network connectivity, temporary latency or interruptions may occur.
• ✦If an AI reading fails to generate due to a network interruption or server timeout, any virtual Coins deducted for that session will be automatically refunded to your in-app balance.
• ✦For technical assistance with coin balances or generation issues, contact support@zenithalign.com.

7. User Conduct and Prohibited Activities

You agree not to:

• ✦Use the Service for any unlawful, fraudulent, or harassing purpose
• ✦Submit abusive, defamatory, obscene, hateful, or harmful text or imagery into chat or prompt fields
• ✦Decompile, reverse-engineer, disassemble, or attempt to extract source code from the mobile app
• ✦Use automated scrapers, bots, or unauthorized tools to access or harvest data from the Service
• ✦Interfere with, circumvent, or compromise the technical security and integrity of the Service
• ✦Attempt to trade, exploit, or duplicate virtual Coins outside official in-app mechanisms

Violations may result in immediate suspension or termination of app access without liability.

8. User-Submitted Inputs and Content

You retain ownership of any questions, dream entries, and personal descriptions you submit to the Service. By submitting content, you grant Zenith: Cosmic Guide a non-exclusive, worldwide, royalty-free license to process, display, and transmit such content solely to deliver and operate the Service in accordance with our Privacy Policy.

We do not use your private journal entries or questions to train foundational commercial AI models.

9. Intellectual Property

All visual interfaces, design assets, software code, graphic elements, audio soundscapes, AI character designs, and literary content comprising the Service are the exclusive intellectual property of Zenith: Cosmic Guide or our licensors.

The brand name “Zenith: Cosmic Guide,” our logos, and related character marks are protected trademarks. You are granted a limited, personal, non-commercial, revocable, and non-transferable license to use the app for personal wellness and reflection.

10. Privacy and Data Protection

Your privacy is central to our values. Our Privacy Policy and KVKK Aydınlatma Metni describe our data handling, anonymous account architecture, and user rights in full. By using the Service, you acknowledge these policies.

11. Third-Party Links and Services

The Service interacts with third-party infrastructure (such as Apple StoreKit, Supabase, and OpenAI). We do not control and are not liable for third-party platforms, which are governed by their respective terms and conditions.

You agree to indemnify and hold harmless Zenith: Cosmic Guide, its operators, agents, and licensors from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of applicable laws.

15. Account Termination and Data Deletion

• ✦Termination by You: You may delete your account and all stored personal data at any time via Settings → Delete Account. Data is deleted immediately and permanently. Subscriptions must be cancelled separately through iOS Settings.
• ✦Termination by Us: We may suspend or terminate your access immediately if you violate these Terms, engage in fraud, or abuse our systems.
• ✦Provisions that by their nature should survive termination (including intellectual property, disclaimers, liability limitations, and governing law) shall survive.

16. Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to the Service shall be governed by and construed in accordance with the laws of Turkey (Republic of Türkiye).

Consumer Rights Reserved: Nothing in these Terms shall limit or diminish the statutory rights afforded to consumers under the mandatory consumer protection laws of their habitual country of residence. Consumers resident in Turkey retain the full right to apply to Consumer Arbitration Committees (Tüketici Hakem Heyetleri) or Consumer Courts (Tüketici Mahkemeleri) within statutory monetary limits. Consumers residing in the European Union or the United Kingdom retain the protection of the mandatory consumer regulations and access to competent consumer courts in their respective jurisdictions.

17. Dispute Resolution

In the event of any disagreement or concern, we encourage you to contact us first at support@zenithalign.com so we may seek an amicable, good-faith resolution. If a dispute cannot be resolved informally, it shall be submitted to the competent courts and enforcement offices in accordance with Section 16.

18. Changes to These Terms

We reserve the right to revise these Terms periodically. Notice of material updates will be provided by updating the “Last Updated” date and, where practical, via an in-app notice. Your continued use of the Service after revised Terms become effective constitutes your acceptance of those revisions.

19. Apple-Specific Terms (App Store EULA)

• ✦These Terms are concluded solely between you and Zenith: Cosmic Guide, and not with Apple Inc. Apple is not responsible for the mobile app or its contents.
• ✦Apple has no obligation to provide maintenance or technical support services for the app.
• ✦To the maximum extent permitted by law, Apple carries no warranty obligations regarding the app.
• ✦Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
